This is ridiculous. He was in the privacy of his own home and she only saw him because she was crossing his property. How can he be faulted for that. She is the one that should be charged with trespassing and being a peeping tom.

I totally agree. Why was she up at that hour with a child anyway? Why was she on HIS property! Should I undress IN my shower now, too?:laughitup:
 
Be interesting to see where this goes. I'm surprised (ok, not really) that the article didn't mention illegally trespassing on his private property and being a peeping tom!

On the trespass portion since so many people have brought it up.

In most states unless your property is posted then anyone can be on your property at anytime until served written notice that they are trespassing or have been served with a written notice. Some states allow verbal notice.

On the indecent exposure part - it all depends on how the law is written in that community.

In most communities in VT you can be nude as long as you are not lewd. IE pretty much waiving them around for the world to see.

In ME it is the exposure of the sexual organs, therefore most women can walk around nude unless they decide to spread their legs, whereas men cannot. This was highlighted this summer over a restraunt in Greenville that will give you a free lunch if you jump off the back dock in your birthday suit. 3 people did it on the wrong day - 2 males and a female. All 3 were summonsed for indecent exposure because someone complained, however a judge threw out the females since she technically did not expose her sexual organs. The 2 males were given fines, and now are considered sex offenders and will have to register for the rest of their lives on the registry.
 
This is proof how dumb people are getting. The man is in his own home! And I argree with all of you she was a peeping tom. Had HE walked passed, saw HER naked, and called the cops-regardless if he had a child with him-that man would have been arrested for trespassing and peeping, and she probably would have tried to pass some "sexual harassment//mental distress" cr@p charges, too!! So, that woman should be charged instead.

That's a bunch of bull. In the privacy of your own home you should be able to do as ypu please. As far as I'm concerned she had no business in his yard at all, regaurdless of what time it was. Now if that was a man who saw a women naked and called the cops, he would be a peeping Tom without a doubt! But, beacuse it was the other way around this man is being charged with bulls***! Next it will be illegal to conduct sexual issues in your own bedroom! Afterall, what if a mother and a 7 year old boy were walking through your yard at midnight and caught you in the act with your lover? That poor guy!
 
A neighbor saw a guy next door to her, in the 2nd floor window, pl__ing with himself, while looking into her patio where her [and my] kids were playing!
She didn't scream or anything, came to my house, [with the kids] where we called police!
They walked over there, where he was still at it, unaware he could be seen!
The police knocked on the door, and it took about 5 min. for him to answer. After "talking" to him, they came back and said they couldn't arrest him, because he was in his own house, and it was considered "peeping" on the neighbors part!
To me, this was "lewd conduct", but again they said she was "peeping" - they said they could do nothing but tell him to close the drapes!
I guess the law was on his side, or the cops didn't want to make a big deal of it, but where kids are concerned, I felt he should've been charged!
Different states do things different ways - wish they'd all get together! Nude at home is one thing - lewd behavior is another!
 
Wow, this is rediculous. I walk around my house naked in the morning and at night everyday. lol. I am always either alone, or it's just me and my husband. But point is, it is MY HOUSE. So what, if you have a window in your bathroom and some peeping tom comes around before you are about to get in your shower, you get arrested for being naked? That is so stupid. I can't believe he actually got arrested for it. WTF? I agree-the lady should be arrested for being a perv. The sad thing is that you know darn well if the situation had been reversed, and the man saw the woman naked in her home, the man would have been arrested and the woman would be getting much sympathy for her "traumatizing event". That is just stupid.

ETA* sorry Nicky, I didn't scroll through all of the posts, I guess we are on the same wave length of thinking. lol.

Ummmm.... I live next to a state trooper, and I walk around the house starkers... he's never complained...

If the guy had been dancing around shaking his goodies at the window, I could understand the traumatic part, but he was in the privacy of his own home. I hate having my blinds closed - I don't know why, I just feel like I'm in a cave. My blinds are open 24/7, and my attitude is if someone really wants to see me in my birthday suit, they deserve what they get!!
 
The whole thing is ridiculous. He should sue her for wrongful something or other because he lost his job and is having troubles seeing his daughter because of HER staring in the windows. Windows are on houses to let light and air in... not for people to see what you're doing.

I go from my house to my pool naked... if anyone has a problem with that they shouldn't be looking in my yard! I'm sure he was thinking man.. it's 5:30 and some lady with a kid is going to be walking by any minute now... the world is getting stupider every day...
 
I'm glad he was acquitted. Frankly I think this lady is nuts and her reaction to the incident probably had more of a negative effect on her son than the actual 'sighting' did. If it were me, I'd would have just kept walking...its not like he was parading in the street or anything. If you're looking in people windows at that hour you're going to see things you don't want to. I don't think it should have ever gone to trial and a lot of people's time was wasted.
